I, hereby acknowledge and agree to the following terms and conditions related to the roadside assistance services provided by Auto Rescue Experts Roadside and its technicians:
I understand that Auto Rescue Experts Roadside will provide the requested service to my vehicle, including but not limited to tire changes, fuel delivery, and lockout assistance. I acknowledge that the technician will perform the service to the best of their ability, and any damage that occurs during or after the service is not the responsibility of Auto Rescue Experts Roadside or its technicians unless directly caused by gross negligence or intentional misconduct.
I understand that roadside assistance services, including but not limited to tire changes, fuel delivery, and lockout assistance, may involve certain risks and potential for incidental damage. These risks may include, but are not limited to, minor cosmetic damage to the vehicle, damage caused by pre-existing conditions, and other unforeseen circumstances. I accept these risks as inherent in the service provided.
I agree that Auto Rescue Experts Roadside, its employees, and contractors, shall not be held liable for any damage to my vehicle, property, or any third-party property, except in cases of gross negligence or intentional misconduct by the technician while providing the service.
By agreeing to these terms and conditions, I fully release and discharge Auto Rescue Experts Roadside and its technicians from all claims, demands, actions, or causes of action, whether for property damage, personal injury, or other losses, that may arise from the roadside assistance service provided, unless such claims are caused by the technician’s gross negligence or intentional misconduct.
I acknowledge that any damage or condition to my vehicle that existed prior to the service was disclosed to the technician, and I am responsible for any repairs or damage claims that relate to pre-existing conditions. If any damage is found after service, I agree to cooperate with Auto Rescue Experts Roadside in determining the cause and extent of the damage.
I agree to indemnify, defend, and hold harmless Auto Rescue Experts Roadside, its technicians, and employees, from all claims, damages, or expenses arising out of my use of the service, including any damage to my vehicle, unless caused by gross negligence or intentional misconduct.
I understand that the outcome of roadside assistance services may not always be guaranteed, and I agree that Auto Rescue Experts Roadside is not responsible for circumstances beyond its control, such as vehicle mechanical failures, inclement weather, or other factors that could prevent the successful completion of the requested service.
I hereby confirm that I have read and understand the contents of these terms and conditions. I agree to release Auto Rescue Experts Roadside and its technicians from any liability, as outlined in the terms above, and accept the risks associated with the roadside assistance services provided. By agreeing to these terms and conditions, I acknowledge that I have voluntarily entered into this agreement and that I am authorized to waive liability on behalf of myself and any others involved.
